Terms of Service

1. Acceptance of Terms
By accessing or using the DineByQR platform ("Service"), operated by DineByQR Technologies Pvt Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
DineByQR provides a cloud-based QR code ordering, kitchen display, billing, and restaurant management platform available via web browsers and dedicated dashboard applications. The Service includes QR menu generation, real-time order management, GST-compliant invoicing, analytics, and related tools.
3. User Accounts
3.1 Registration
To use the Service, restaurants must create an account providing accurate business information including restaurant name, GSTIN (if applicable), contact details, and authorized representative information.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account at hello@dinebyqr.com.
4. Subscription & Billing
- DineByQR operates on a subscription model with monthly or annual billing cycles.
- We do not charge per-transaction commissions on orders placed through the platform.
- Subscription fees are non-refundable except where required by applicable law or stated in our refund policy.
- We reserve the right to change pricing with 30 days' prior written notice.
5. Restaurant Responsibilities
As a restaurant using DineByQR, you agree to:
- Maintain accurate, up-to-date menu information (prices, availability, allergen info)
- Process customer orders in a timely manner
- Comply with all applicable food safety, taxation, and business regulations
- Not use the platform for any unlawful purpose
6. Customer Data & Privacy
Customer data collected through QR ordering (name, phone, order history) is governed by our Privacy Policy. Restaurants agree not to misuse, sell, or share customer data outside of their legitimate business operations.
7. Intellectual Property
The DineByQR platform, including its software, design, branding, and documentation, is the intellectual property of DineByQR Technologies Pvt Ltd. Restaurants retain ownership of their menu content, images, and business data uploaded to the platform.
8. Service Availability
We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated at least 24 hours in advance. We are not liable for downtime caused by factors beyond our control (internet outages, force majeure, etc.).
9. Limitation of Liability
To the maximum extent permitted by law, DineByQR shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service, including but not limited to lost revenue, data loss, or business interruption.
10. Termination
Either party may terminate the subscription with 30 days' written notice. Upon termination, restaurant data will be available for export for 90 days, after which it may be permanently deleted.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kochi, Kerala.
